Terms of Service

By creating an account or using HAI Messenger or H AI, you agree to these terms. If you don't agree, please don't use the service.

1. The service

HAI Messenger is a free, self-hosted, end-to-end encrypted chat application, offered as-is by its operator. H AI is a companion assistant running on a locally-hosted language model. Both are provided free of charge, with no subscriptions or ads.

2. Eligibility

You must be old enough to legally consent to the processing of your own data under the laws that apply to you (commonly 13, but higher in some places) to create an account. If you're using this on behalf of someone younger than that, you shouldn't create them an account.

3. Your account

You're responsible for keeping your password secure and for anything that happens under your account. Your encryption keypair is generated and stored on your own device — if you lose access to every device that holds it (and haven't backed it up where the app offers that option), messages encrypted to that key can't be recovered by the operator, because the operator never had the key in the first place.

4. Acceptable use

You agree not to use HAI Messenger or H AI to:

Harass, threaten, or abuse other users, including through the anonymous Nearby feature.
Share illegal content, including content that exploits or endangers minors — this will be reported to the relevant authorities where legally required, to the extent the operator becomes aware of it.
Impersonate another person or misrepresent your affiliation with anyone.
Attempt to break, bypass, or reverse-engineer the app's encryption or access controls, or interfere with other users' accounts.
Send spam, unsolicited bulk messages, or use the service for automated abuse.
Use H AI to generate content that violates these terms, and treat its answers as informational only — H can be wrong, and its replies aren't professional, medical, legal, or financial advice.

Because messages are end-to-end encrypted, the operator generally cannot see message content and relies on user reports to enforce this policy. Accounts found to violate these terms may be suspended or terminated.

5. Your content

You retain ownership of whatever you send through the service. You're solely responsible for the content of your own messages and for having the right to share anything you send.

6. Nearby chat

Nearby connects you with anonymous, unverified people nearby for a self-destructing, 24-hour conversation. The operator cannot verify the identity, age, or intentions of anyone you meet through Nearby. Use it thoughtfully, and don't share information you wouldn't want an anonymous stranger to have.

7. Availability

This is self-hosted software provided "as is" and "as available," without warranties of any kind. The operator does not guarantee uninterrupted access, and the service may be modified, suspended, or discontinued at any time, with or without notice.

8. Limitation of liability

To the fullest extent permitted by law, the operator is not liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, HAI Messenger or H AI — including loss of messages, loss of access to encrypted data, or harm arising from interactions with other users (including through Nearby).

9. Termination

You can delete your account at any time from Settings. The operator may suspend or terminate accounts that violate these terms, or discontinue the service entirely, at its discretion.

10. Changes to these terms

These terms may be updated from time to time; the "last updated" date above will reflect that. Continuing to use the service after a change means you accept the revised terms.
